Last Will and Testament.
A Will is the foundation of an effective estate plan. Most Americans don’t take the time to have a Will drafted, which means that individual dies “intestate”. In Louisiana, if you die without the benefit of a Will, the State of Louisiana’s intestacy laws determine who will inherit your estate. If you wish to maintain control of your estate and direct where your assets go upon your death, you need a Will in order to do so. Most Wills are concise & inexpensive. The Will affords the Testator (person making the Will) the authority to determine where their assets go upon their death.
A Succession is the is the process of settling a deceased person’s estate and distributing the property after debts are repaid. It is typically a simple court proceeding where the attorney verifies the personal information of the deceased, lists all assets and debts of the deceased on a document (a “Sworn Descriptive List”) and then asks the Court to order that the assets of the decedent be placed into possession of the heirs or legatees (people named in a Will).
